A lien is any claim from a 3rd party that figuratively attaches to the title of your property. A lien has a monetary value that needs to be resolved prior to conveying title to your property “free and clear” (which is actually an inference for “free and clear of any liens or encumbrances”). Liens can be in the form of a mortgage, the result of a claim of non-payment to a contractor that performed work on the subject property, or as a penalty for non-compliance with ordinances from a local municipality. In some cases, it is possible for the IRS to place a lien against a property as well.
In many cases, these liens can be satisfied at closing either with sale proceeds, or through negotiations for a partial payment in exchange for a release of lien.
